Getting Started with Your EB-5 Application

What You’ll Need:

  • Passport: A valid passport from your home country is necessary for identification and travel purposes.
  • Birth Certificate: Your birth certificate provides proof of your identity and nationality.
  • Marriage Certificate: If you are married and including your spouse in the application, you’ll need a marriage certificate to establish the relationship.
  • Divorce or Death Certificates (if applicable): If you have been previously married, you may need divorce or death certificates to show the termination of previous marriages.
  • Form I-526 Petition: The completed and signed Form I-526 is the primary petition for alien investors, outlining your eligibility for the EB-5 program.
  • Investment Documentation: Depending on whether you are making a direct investment or investing through a regional center, you’ll need documentation related to the investment project, such as a business plan, financial projections, offering documents, and the subscription agreement.
  • Source of Funds Documentation: To demonstrate the lawful source of your investment funds, you’ll need various financial documents, such as bank statements, tax returns, pay stubs, business records, sale of assets documents, and gift letters (if applicable).
  • Educational and Employment Records: Supporting documentation for your education and employment history is necessary to establish your qualifications for the EB-5 program.
  • Proof of Business Ownership (if applicable): If you are a business owner, you’ll need documentation, such as articles of incorporation, business licenses, and financial records, to verify your ownership and the legitimacy of your business.
  • Translations: Any documents that are not in English must be accompanied by certified translations.
  • Photographs: Recent passport-sized photographs meeting USCIS requirements will be needed for your application.
  • Filing Fees: Payment for the required USCIS filing fees must be included with your application.
